TERMS AND CONDITIONS OF SALE

These General Terms and Conditions of Sale (hereinafter "T&Cs") govern the contractual relationship between Maison LUMALYS and any natural person of legal age (hereinafter "the Customer") making a reservation for wellness services and/or accommodation via the website www.maisonlumalys.com, the Fresha platform or by direct contact.

2. Purpose

The purpose of these T&Cs is to define the conditions under which Maison LUMALYS offers:

  • Our wellness services (spa rituals, solo or couple's massages)

  • Our tourist accommodation services (seasonal rental of a private chalet)

  • as well as offers combining accommodation and wellness services.

3. Nature of wellness services

The services offered are exclusively for wellness and relaxation purposes..

They do not constitute:

  • medical procedures,

  • therapeutic or paramedical procedures,

  • or treatments intended to cure illness.

The massages offered are in no way sensual, tantric, sexual, or erotic in nature. No requests of this nature will be tolerated.

Some services incorporate a gentle energy-based approach, with the aim of relaxation, harmonisation and overall revitalisation, without diagnosis or therapeutic promises.

The massages are performed by independent partner practitioners, under the coordination of Mathilde Rivière, manager of Maison LUMALYS.

4. Booking and payment conditions

4.1 Booking

Bookings can be made:

  • via the Fresha platform,

  • or, in exceptional cases, by direct contact.

All bookings imply full and complete acceptance of these T&Cs.

4.2 Payment

Full payment is required at the time of booking..

Accepted payment methods:

  • bank card via Fresha,

  • direct payment by bank card,

  • cas payment in advance, to be sent or delivered to the address of Maison LUMALYS.

No services will be provided without full payment in advance.

5. Cancellation policy - Wellness services

5.1 Cancellation by the customer

No refunds will be given.

However, two postponements of appointments may be granted free of charge, subject to:

  • informing Maison LUMALYS at least 24 hours before the scheduled date

Beyond two postponements, or in the event of late cancellation (less than 24 hours), the service is due and definitively lost, with no possibility of refund or postponement.

5.2 Delays

Any delay of over 20 minutes will result in the loss of the service, with no refund or postponement possible.

6. Cancellation conditions - Accommodation (seasonal rental)

6.1 Cancellation by the customer

  • Free cancellation up to 8 days before the date of arrival.

  • Between 8 days and 48 hours before arrival: 30% of the total amount of the stay is due..

  • Less than 48 hours before arrival: 60% of the total amount of the stay is due..

No refunds will be made for shortened or unused stays.

6.2 Cleaning

Cleaning is included in the price of the stay, as is tourist tax.

6.3 Tourist tax

In accordance with current regulations, a tourist tax is applicable to stays in accommodation provided by Maison LUMALYS.

As the accommodation is As the accommodation is classified as a 4-star furnished tourist accommodation, the tourist tax is calculated on the basis of the rate set by the competent local authority, per person per night, for adults.

The amount of the tourist tax is included in the total price of the stay, unless otherwise stated at the time of booking.

The tourist tax is paid in full to the local authority concerned and contributes to the financing of tourism development initiatives in the area.

7. Schedules and procedures

The schedules for wellness services are strict strict and displayed:

  • on the website,

  • and on the Fresha booking schedule.

For accommodation, requests for long-term stays on dates other than those displayed may be considered upon prior request, without obligation to accept.

8. Specific conditions for wellness

The Customer acknowledges:

  • that the services are not therapeutic, sexual, sensual or tantric in nature.

  • that they are responsible for reporting any contraindications, pathologies, pregnancies or specific medical conditions before the service.

Maison LUMALYS reserves the right to refuse or interrupt a service if the Customer's condition is deemed incompatible with a wellness practice, without any possibility of reimbursement.

9. Liability and insurance

Maison LUMALYS is covered by Professional Civil Liability insurance, including partner practitioners involved in the services offered.

Maison LUMALYS cannot be held liable in the event of:

  • failure to follow instructions,

  • omission of medical information by the Client,

  • or inappropriate behaviour.

10. Right of withdrawal

In accordance with Article L221-28 of the Consumer Code, the right of withdrawal is excluded for services provided on a specific date or at specific intervals, since the booking results in the reservation of a specific slot and a loss of opportunity for the service provider.

11. Personal data

Personal data is processed in accordance with the Privacy policy available on the website www.maisonlumalys.com

12. Disputes and applicable law

These GTC are subject to French law.

In the event of a dispute, an attempt to reach an amicable resolution will be preferred. If no agreement can be reached, the competent courts will be those of the company's registered office.
